Packaging Waste Requirements
Packaging Waste Requirements refer to the EU legislation mandated by the Packaging and Packaging Waste Directive (94/62/EC). For North American machinery manufacturers, this regulation is often an overlooked aspect of Placing on the Market. It applies to all materials used to contain, protect, handle, and deliver goods, including heavy-duty shipping crates, wooden pallets, and plastic shrink wrap used for transport.
To comply, manufacturers must ensure their packaging meets specific "essential requirements." Firstly, packaging volume and weight must be limited to the minimum adequate amount to maintain safety. Secondly, the materials must be recoverable or recyclable. Crucially, the concentration of heavy metals (lead, cadmium, mercury, and hexavalent chromium) must not exceed 100 ppm. This aligns with broader chemical safety protocols like the REACH Regulation.
Failure to comply can lead to shipments being held at customs. While the EU Importer is typically the entity legally responsible for recycling fees (under Extended Producer Responsibility schemes), they will require Supplier Declarations from North American partners confirming that all transport packaging is compliant and free from prohibited substances.
